Criminal sexual conduct(CSC) is defined and punished as such:

1^st degree CSC: Engaging in sexual battery with the victim using aggravated force, forcible confinement, kidnapping, trafficking, robbery, extortion, burglary, housebreaking, or any other similar offense or act. It also involves acts that cause the victim to become mentally incapacitated or physically helpless by giving them a controlled substance or any intoxicating substance.

• This is a felony punishable by up to 30 years in prison.

2^nd degree CSC: Using aggravated coercion to accomplish sexual battery.

• This is a felony punishable by up to 20 years in prison.

3^rd degree CSC: Engaging in sexual battery with the victim using force or coercion to accomplish the sexual battery in the absence of aggravating circumstances; or knowing or having a reason to know that the victim is mentally defective, mentally incapacitated, or physically helpless and aggravated force or aggravated coercion was not used to accomplish sexual battery. A person cannot be guilty of this crime if the victim is the legal spouse of the person unless the couple is living apart or if the purported marriage includes a male under the age of 16 or a female under the age of 14.

• This is a felony punishable by up to 10 years in prison.
